Terms of Service

1. Acceptance of Terms
By accessing or using MedicaidIQ ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.
2. Description of Service
MedicaidIQ provides structured access to publicly available Medicaid managed care contract data, including state plan amendments, waiver documents, and related regulatory filings. The Service aggregates, extracts, and organizes this information to support research, analysis, and compliance workflows.
3. Accounts
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the integrity or performance of the Service
- Scrape, crawl, or use automated means to access the Service beyond its intended APIs
- Resell, redistribute, or sublicense access to the Service without written consent
- Misrepresent data obtained from the Service as your own original research
5. Data Accuracy
MedicaidIQ extracts and structures data from publicly available government documents using automated processes. While we strive for accuracy, the Service is provided for informational purposes only and should not be relied upon as a sole source for legal, regulatory, or clinical decisions. We recommend verifying critical information against original source documents.
6. Intellectual Property
The Service, including its design, software, and proprietary extraction methods, is owned by MedicaidIQ. You retain ownership of any content you upload or create within the Service. By using the Service, we grant you a limited, non-exclusive, non-transferable license to access and use it for your internal business purposes.
7. Payment and Billing
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days notice. Failure to pay may result in suspension or termination of your account.
8. Termination
Either party may terminate this agreement at any time. We may suspend or terminate your access if you violate these terms. Upon termination, your right to use the Service ceases immediately. We will make your data available for export for 30 days following termination.
9. Limitation of Liability
To the maximum extent permitted by law, MedicaidIQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Changes to Terms
We reserve the right to modify these terms at any time. We will provide notice of material changes by posting updated terms on this page and updating the effective date. Continued use of the Service after changes constitutes acceptance of the revised terms.
12. Governing Law
These terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these terms or the Service shall be resolved in the state or federal courts located in Delaware.
